CASPER, Wyo. (KGWN) - A Wyoming businessman is set to stand trial again in November on a sole remaining count of third-degree sexual assault.
Tony Cercy appeared in court with his attorneys on Thursday, two months after a jury acquitted him on two sexual assault charges. The jury deadlocked on the third count, and the judge declared a mistrial.
Prosecutors say the Casper businessman sexually assaulted a woman as she slept on a couch at his house in June. Cercy testified he did not have sexual contact with the woman.
His attorneys argued Thursday that the Nov. 13 trial should be moved out of Natrona County because some of the media coverage was inaccurate. But the judge denied the motion, saying the media's reporting had been generally factual.
